Ossic Warranty Policy
OSSIC warrants the Product is free from defects in manufacturing, materials, and workmanship under normal and intended use for the applicable Warranty Period (as defined below) from the date of original retail purchase. OSSIC’s Warranty Period is defined as a period of 1 year from the date of delivery to the original end-use purchaser, subject to local law, when used normally in accordance with the instructions, warnings, manuals, labels and Terms & Conditions provided with the product physically and available on-line.
If a defect covered by this Limited Product Warranty Policy arises during the Warranty Period, OSSIC, at its sole discretion will use commercially reasonable efforts to do one of the following: (1) repair the Product at no charge using new parts or parts that OSSIC considers are equivalent to new in performance and reliability, ; (2) exchange the Product with a product with equivalent functionality formed from new and/or previously used parts that OSSIC considers are equivalent to new in performance and reliability or a product that is at least functionally equivalent to the product it replaces, ; or (3) refund the original purchase price.
This warranty excludes:
- Normal depletion of consumable parts such as batteries. OSSIC does not provide any warranties for the battery life, as all rechargeable batteries can be expected to lose charging capacity over time and this is not considered a defect. Your actual battery life will vary depending on the conditions in which it is used.
- Damage resulting from abuse, misuse, failure to follow operating instructions; accident; moisture; lightning; power surges; connections to improper voltage supply; modifications; unauthorized repairs or other causes that are not defects in materials and workmanship.
- Cosmetic damage, minor cosmetic abnormalities, and normal wear and tear, including (without limitation), scratches, dents and paint chips.
- Software, including (without limitation) (i) the operating system and software used with the OSSIC Product and OSSIC desktop and mobile apps, (ii) third-party software, or (iii) the reloading of software, software configurations or any data files
- Products with a serial number that has been altered, obliterated or removed
- Products for which OSSIC will not receive payment
The limited warranty set forth herein shall be void and of no further force or effect immediately upon the occurrence of any of the following: (a) the expiration of the Warranty Period, (b) the sale, assignment, transfer or other disposition of any Product(s) by you, (c) any modification or alteration of any Product(s) other than by OSSIC, (d) any operation or use of the Product(s) not in accordance with the User Manual , or (f) your failure to provide OSSIC (or its designee) access to the Product(s).
To obtain warranty service, go to www.ossic.com/support to obtain a Return Merchandise Authorization Number ("RMA Number") and OSSIC shipping address. Label and ship the product, freight prepaid, to the address provided by OSSIC customer support. Include a valid proof of purchase (receipt must show the Product description and price) and the reason for the return inside the package. Place the RMA Number prominently on the outside of the carton.
OSSIC will not pay shipping, insurance or transportation charges from you to us, or any import fees, duties, or taxes. If the Product is validly returned under the terms of this Limited Warranty, OSSIC will be responsible for postage expenses for shipping the Product back to you but not any related customs charges, duties, or taxes. You are responsible for ensuring that the Product is properly packaged and you will bear the full risk of loss or damage for any Product that is returned improperly packaged. Risk of loss or damage in the returned Product only transfers to OSSIC when the Product is received by OSSIC. OSSIC will not be responsible for items lost in transit to us.
If OSSIC receives a Product from you that does not meet the requirements of this Limited Warranty, including (but not limited to) a Product that (a) lacks a valid RMA Number, (b) is not accompanied by a valid Proof of Purchase, (c) does not have a valid serial number or the label bearing the serial number has been removed or defaced, (d) is no longer covered under the Warranty Period, or (e) does not have a defect covered by this Limited Warranty, you may be responsible for an assessment fee, return shipping and handling fees, and other reasonable fees as may be required by OSSIC prior to the Product being returned to you.
ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE DURATION OF THE APPLICABLE WARRANTY PERIOD. ALL OTHER EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF NON-INFRINGEMENT, ARE DISCLAIMED. This Warranty is governed by and interpreted under the laws of the country or jurisdiction in which the product purchase took place. Some jurisdictions may not allow limitations on implied warranties or the exclusion or limitation of incidental or consequential damages, in which case the above limitations or exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL OSSIC OR ITS AFFILIATES, HAVE ANY LIABILITY ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PRODUCT FOR PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, COST OF SUBSTITUTE GOODS OR SERVICES, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COMPUTER FAILURE OR MALFUNCTION, OR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGE. IN NO EVENT SHALL OSSIC'S OR ITS LICENSOR’S OR SUPPLIERS' TOTAL CUMULATIVE LIABILITY EXCEED FIVE HUNDRED DOLLARS (US $500). END USER ACKNOWLEDGES THAT THIS PROVISION REFLECTS A REASONABLE ALLOCATION OF RISK AND THAT THE TERMS IN THIS SECTION SHALL APPLY EVEN IF AN EXCLUSIVE OR LIMITED REMEDY STATED HEREIN FAILS OF ITS ESSENTIAL PURPOSE.
